Before joining the firm, Misti was a litigator for over seven years in the intellectual property litigation department at Robins, Kaplan, Miller & Ciresi L.L.P. in Minneapolis. Misti represented clients in complex patent infringement, breach of contract, and trade secret lawsuits involving diverse technologies ranging from medical devices and procedures, to magnetic resonance imaging machines, and computer hardware and software. She also represented clients in trademark opposition litigation before the United States Trademark & Trial Appeal Board. Misti has extensive experience in all aspects of litigation, from pre-suit investigation to discovery, trial, and appeal. Misti’s practice is focused on the representation of businesses and individuals in intellectual property and commercial litigation. A life-long Minnesota resident, Misti grew up in the small hockey town of Roseau, Minnesota, and graduated from Saint Olaf College in Northfield, Minnesota, and the University of Minnesota Law School. While studying English and economics at Saint Olaf College, Misti was a member of the Senior Women’s Honor Society and graduated magna cum laude and Phi Beta Kappa. During law school, Misti was a member of the Journal of Law & Inequality, and graduated cum laude in May of 1999. In her personal life, Misti likes to travel the world with her husband Michael, participate in triathlons, and run, bike, and in-line skate on the Twin Cities’ glorious bike paths. Selected ResultsCounsel in TV Interactive Data Corporation v. Microsoft Corp., No. C02-02385 (N.D. Ca., filed May, 2002). Misti was a member of a team that represented TVI, a small California technology company, in a case brought against Microsoft. Plaintiff TVI asserted that Microsoft's Windows operating system infringed several TVI patents, which included apparatus and method claims for autoplaying media on insertion in a drive. TVI accused all versions of Windows from Windows 95 forward of infringement. The case settled in October 2005 with Microsoft taking a license under the patents. Bar Admissions

Civic AssociationsMisti volunteers at Lincoln Adult Education Center, which is located in downtown Minneapolis. She is a teacher’s assistant in English as a second language (ESL) classes, and she tutors adult immigrants to help them improve their English.
